The Nordy Club Canada Terms & Conditions
THE NORDY CLUB CANADA TERMS AND CONDITIONS
The Nordy Club Member Program (the "Program") is offered exclusively by Nordstrom Canada Retail, Inc. ("Nordstrom"). Members (also referred to as "you" and "your") participating in the Program agree to be bound by these Nordy Club Terms and Conditions (Member Program) ("Terms and Conditions"), as they may change from time to time. These terms and conditions form a binding contract between you and Nordstrom (also referred to as "we," "our," or "us").
General Terms and Conditions
The Program operates under the Terms and Conditions ("Program Rules") as set out below, unless expressly stated otherwise, and governs our relationship with you within this Program. We reserve the right to change the Program Rules, or the Program, at any time and in any way or terminate the program without notice to you. To the extent required by applicable law, we will provide notice if we end the Program or make a material change to it. We reserve the right to cancel or suspend your participation in the Program in the event of fraud, abuse of rewards privileges, violation of these Program Rules or any applicable laws, or at our discretion. Any rewards points in the account will become void at the time of cancellation.
You are responsible for any tax liability related to your participation in the Program. These Terms and Conditions will be construed and interpreted under the laws of the Province of Ontario, without regard to any conflict of law provisions. Any dispute in respect of the Program or these Terms and Conditions shall be brought in any court of competent jurisdiction in the City of Toronto in the Province of Ontario. If any part of these Terms and Conditions is found to be void or unenforceable under applicable law, all other parts of these Terms and Conditions will still apply.
All Program benefits, offers, rewards, and services are subject to availability and may be changed by Nordstrom at any time without notice. At Nordstrom's sole discretion, Nordstrom may choose to substitute a similar loyalty program for The Nordy Club at any time immediately upon notice to active Members. If The Nordy Club is terminated, all unredeemed benefits will be forfeited without any obligation or liability and will not be honored after the conclusion of the notice period. Members are responsible for remaining knowledgeable of the Program Rules and any program rule changes.
Participation in the Program as a Member is available to any Canadian resident who is the age of majority and in his or her jurisdiction of residence is legally capable of entering into the Program and is able to provide a unique and valid email address or mobile number. Corporations, groups, and associations are not eligible to participate. Nordstrom employees are eligible to participate in the Program with limitations, including, but not limited to, not eligible to participate in promotional offers and not eligible for any other benefits associated with Insider Status or above of the Program. Purchases made by Nordstrom employees, or eligible family members of Nordstrom employees, using their employee discount, are not eligible to receive bonus points.
You will receive one rewards point for every $1 of Net Purchases ("Net Purchase" means purchases less returns, discounts, purchases made with Nordstrom Notes or a Nordstrom Gift Card, and any applicable taxes) at participating Nordstrom Location(s) in Canada and the United States and online ("Nordstrom Location(s)" means Nordstrom full-line stores, Nordstrom Rack stores, Nordstrom.com, Nordstrom.ca, Nordstromrack.com).
For Net Purchases denominated in Canadian dollars, you will receive one rewards point for every CAD $1. For Net Purchases denominated in U.S. dollars, you will receive one rewards point for every USD $1. For example, if you purchase a CAD $50 item at a Nordstrom store in Canada, you will receive 50 rewards points. If you purchase a USD $50 item at a Nordstrom store in the United States, you will receive 50 rewards points.
To receive your points, you must self-identify as a Member of the Program at the time of purchase. Points have no cash value and cannot be exchanged for cash or credit. You have no ownership interest in collected points, and points collected do not constitute property. Use of the word "earn" or similar language in marketing materials in relation to the Program does not imply that the points have any value prior to redemption. Points may not be purchased or sold and are not transferable except as otherwise stated herein.
If you return an item and received points for that purchase, those points will be deducted from your account balance. This may result in a negative points balance.
You will receive a $20 CAD Nordstrom Note for every 2,000 rewards points earned. Nordstrom Notes are generated within a reasonable time thereafter. Generally, you will be alerted, by email, when you have Nordstrom Notes available for use. Nordstrom Notes may not be used as payment on a Nordstrom credit card balance. The value of Nordstrom Notes will be applied against total purchase price, including applicable taxes and fees.
Nordstrom Notes earned under the Program will be denominated in CAD and are subject to a currency exchange rate conversion when used at Nordstrom stores located in the United States. The Canadian Dollar to U.S. Dollar exchange rate that will be applied to your Nordstrom Note redemption at Nordstrom and Nordstrom Rack stores in the United States will be the rate provided to Nordstrom by Thomson Reuters.
Unlocking Program Status and Benefits
Members receive the benefits set forth below. All Program participants are Members. Your eligibility to achieve Insider, Influencer and Ambassador Status in the Program ("Nordy Club Status") is based on your cumulative Net Purchases made when making purchases as a Member at Nordstrom Location(s). Your eligibility to move up in status within the Program will be updated regularly based on your Net Purchases as set forth below. Generally, we will send you a notice, via email, when you have unlocked a new Nordy Club Status. At that time, we will also send you information about the benefits associated with your new status and how to redeem those benefits. In addition to what is set forth below, some benefits may have restrictions associated with them, may require you to purchase the benefit, or may have limited availability.

To be eligible for Insider Status, you must purchase an annual minimum of $500 in Net Purchases at Nordstrom Location(s). In addition to the Member benefits, Insiders receive:
• 1 Personal Double Points Day
To be eligible for Influencer Status, you must purchase an annual minimum of $2,000 in Net Purchases at Nordstrom Location(s). In addition to the Member benefits, Influencers receive:
• 2 Personal Double Points Days
• Priority Access to Style Events
To be eligible for Ambassador Status of the Program, you must purchase an annual minimum of $5,000 in Net Purchases at Nordstrom Location(s). In addition to the Member benefits, Ambassadors receive:
• 3 Personal Double Points Days
• Priority Access to Style Events
• Nordstrom to You (In-Home Stylist)
• Access to Invite-Only Events
Once you reach the qualifying Net Purchases for any status, your benefits for that status include all of the benefits associated with the preceding status.
If you maintain your Net Purchases necessary to achieve Insider, Influencer or Ambassador Status through the end of a calendar year, you will retain your achieved Nordy Club Status, and the accompanying benefits, through the next year; however, your Net Purchases will be reset to zero at the beginning of each calendar year.
Complimentary basic alterations are available to all Members, provided that items being altered must have been purchased from Nordstrom stores, Nordstrom.com, or Nordstrom.ca. Items purchased at any other locations are not eligible for this benefit.
Personal Double Points Days
The Personal Double Points Day benefit allows you to select a day to earn double points on all Net Purchases at Nordstrom when self-identifying as a Member. As you progress through the Program, you are only entitled to the number of Personal Double Points Days for the new status and not the cumulative total of Personal Double Points Days of the previous status and the new status. This means, for example, if your Personal Double Points benefit is one (1) day, and you progress to a status that provides for three (3) days, and you already used one (1) day, you will have two (2) days left.

As set forth above, eligible Members may receive invitations to exclusive shopping and fashion events hosted by Nordstrom and other select benefits (collectively "Event(s)"). These Events are not predetermined and are developed throughout the Program benefit year at Nordstrom’s sole discretion. An opportunity to participate in these Events is not guaranteed due to limited dates, times, locations, or capacity. Participation in an Event may require a purchase at Nordstrom or an additional expense. Complete details for these Events, including any applicable limitations or restrictions, will be sent to selected Members prior to the Event in an invitation or other communication.
Nordy Club points received but not yet converted to a Nordstrom Note will be forfeited three (3) years from the last day of the year in which the points were earned and points balance will be reset to zero, where your Nordy Club account hasn't had any activity during that time.
We will provide notice between 30 and 60 days prior to your points expiring, which notice will set out the expiration date and that your inactivity will result in the expiry of the points.
Nordstrom Notes expire three (3) years from the last day of the year in which the Notes were issued if your Nordy Club account hasn't had any activity during that time, or if you terminate your Membership, whichever is earlier.
To the extent required by applicable law, we will provide notice between 30 and 60 days prior to your notes expiring.
The Nordy Club
The Nordy Club includes distinct programs for non-cardholders (Members) and Nordstrom Cardholders in the United States and Canada. Your Program is administered to you, as a Nordy Club Member in Canada, independently of any cardholder relationship you may have with Nordstrom and is separate and distinct from any other Nordy Club program. Therefore, points received under this Program and points received under any other program offered by Nordstrom are not interchangeable and may not be combined. Purchases attributed to you under the Program and any associated rewards points will be governed by these Terms and Conditions. You may not transfer or assign in any way any of your rights or obligations under these Program Rules. Any such transfer or assignment shall be null and void. Upon the death of a Nordy Club Member, the Member’s account will be closed and any benefits or rewards in the account will be forfeited.
If you use a Canada Nordstrom Visa card to make a purchase or pay for part of a purchase, you will receive points under the rewards program associated with your Canada Nordstrom Visa card and the purchase will be governed by the terms and conditions applicable to the rewards program associated with your Canada Nordstrom Visa card. Canadian customers with a United States Nordstrom Visa, retail or debit card cannot transfer their loyalty account associated with that card to Canada.
If any provision of these Program Rules or the application of any such provision to any person or circumstance is held invalid, illegal, or unenforceable for any reason whatsoever, the remaining provisions of these Program Rules and the application of such provisions to other persons or circumstances shall not be affected. To the fullest extent possible, the court finding such provision invalid, illegal, or unenforceable shall modify and construe the provision so as to render it valid and enforceable as against all persons or entities and to give the maximum possible protection to persons subject to indemnification within the bounds of validity, legality, and enforceability.
Nordstrom’s failure to insist upon or enforce strict compliance with any provision of these Program Rules shall not be construed as a waiver of any provision or right.
The headings for each of these Program Rules are for convenience of reference only. Such headings shall be ignored in the interpretation or construction of any of these Program Rules.
Errors or Inconsistencies
Despite our best efforts to ensure accuracy, errors occasionally occur. We reserve the right to correct such errors at any time even if it affects pending rewards, points or Notes in your account.
In the event of any inconsistency or discrepancy between the Program Rules or other statements contained in any related materials or advertising, the terms of the then-current Program Rules shall prevail, govern, and control. In the event of a discrepancy between the English-language version and the French-language version of the Program Rules, the English version shall prevail, govern, and control in the case of members residing outside the Province of Quebec.
Limitations of Liability and Damages
SOME JURISDICTIONS, INCLUDING THE PROVINCE OF QUEBEC, DO NOT PERMIT THE LIMITATIONS OF CERTAIN RIGHTS, IMPLIED WARRANTIES, OR TYPES OF DAMAGES. If those laws are applicable to you, some or all of the following limitations and waivers may not apply to you. In that event, the limitations and waivers shall be applicable to the fullest extent permitted by law. We make no warranties, express or implied, with respect to The Nordy Club including but not limited to any implied warranty of merchantability or fitness for a particular purpose.
By participating in The Nordy Club, you agree that we have no responsibility or liability for any expense, loss, cost, injury, damage, or any other matter or thing whatsoever, however suffered or caused directly or indirectly arising out of or related to The Nordy Club or these Program Rules, including without limitation: (i) any failure, delay, or decision by us in administering The Nordy Club or these Program Rules, including amendments thereto; (ii) unauthorized use by any third party of your account or Member ID; or (iii) the loss, theft, or delayed notification of any points or rewards issued under The Nordy Club or these Program Rules.
We and you agree that, on any claim arising out of or relating to your participation in The Nordy Club or these Program Rules, to the fullest extent permitted by law, recovery of damages shall be limited to actual and direct damages, and may not include any indirect, special, consequential, enhanced, or punitive damages, and we and you both hereby waive the right to seek or recover any indirect, special, consequential, enhanced, or punitive damages. Any liability we may have to you for any negligence, breach of contract or otherwise, is limited to crediting your account with the points or rewards so determined to be earned by you. These limitations and waivers are intended to be construed broadly, and shall apply to any and all claims arising out of or relating to your participation in The Nordy Club, these Program Rules, against any entity or person affiliated with the Nordstrom brand, and any of their respective directors, officers, employees, or other representatives. The foregoing limitations and waivers shall also survive the termination of these Program Rules.
